General Terms and Conditions for accountplan.net
1 Scope
1) These Terms and Conditions apply to all contracts and services provided in connection with the digital offering accountplan.net.
(2) By using the services, the user agrees to these Terms and Conditions.
2 Subject Matter of the Contract
(1) The provider creates and delivers individually tailored documents for the user (hereinafter referred to as "Documents").
(2) No software or digital applications are provided.
(3) The Documents are based solely on non-confidential information; no confidential or sensitive data is processed.
3 Scope of Services and Waiver of Return Rights
(1) The service includes the creation and delivery of the individual Documents.
(2) Upon receipt of the Documents, the user acquires an unrestricted right of use. The user may copy, save, modify, and use the Documents without limitation.
(3) Since these are individually created Documents, the right of withdrawal, return, or refund is excluded.
4 Rights of Use
(1) Upon receipt of the Documents, the user receives an unlimited, transferable, and irrevocable right of use.
(2) The user is permitted to use, copy, and modify the Documents for both private and commercial purposes.
5 Disclaimer of Liability
(1) The creation of the Documents is carried out to the best of the provider’s knowledge and belief based on the information provided by the user.
(2) The provider accepts no liability for any damages resulting from the use of the Documents, except in cases of intent or gross negligence.
(3) Liability for direct or indirect consequential damages, lost profits, or other financial losses is excluded.
6 Data Protection
(1) The provider collects, processes, and uses personal data only to the extent necessary for the creation of the Documents.
(2) No confidential or sensitive data is processed.
(3) Further details can be found in the separately published Privacy Policy, which forms part of these Terms and Conditions.
7 Data Processing and GDPR
(1) The provider processes the user’s personal data solely for the fulfillment of the contract and in accordance with the legal requirements, in particular the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG).
(2) The processing is carried out only to the extent necessary for the execution of the contract.
(3) The user has the right to access, rectify, erase, restrict processing, and data portability.
(4) The right to object and any further data protection claims can be asserted against the provider.
(5) A detailed description of the data processing and the user's rights is provided in the separate Privacy Policy.
8 Final Provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
(3) The place of jurisdiction, insofar as legally permissible, is the provider's registered office.
